20 Years Jail For Raping Physically Challenged Minor
Balasore, Jan 28: Special judge POCSO Jagadish Prasad Mohanty on Friday awarded 20 years imprisonment along with fine of Rs. 20,000 to a 63 year old man for sexually assaulting a minor girl.
While convicting Manmath Jena in the rape case, the judge ordered that in default of the fine he would undergo another two years jail term.
According to the prosecution, the incident occurred in Dagara village under Baliapal police station in Balasore district on May 16,2018. The convict had sexually assaulted a 10 year old victim who is not only deaf and dumb but also mobility impaired. On the day of occurrence the accused entered to her house in day hours when her parents were out for jobs and sexually assaulted her.
Subsequently, through signs she communicated her ordeals to the grandmother. The father of the victim lodged an FIR and a case was registered under section 376 (A),376(2)(I) of IPC and section 6 of POCSO.
The accused was apprehended and he is in jail since arrest. “The case was tagged as a red flag case and the court on Friday pronounced the judgment after examining 12 witnesses and 18 exhibited documents.
The accused awarded different jail terms under different sections yet he shall undergo jail term for 20 years as they will run concurrently and a penalty of Rs. 20,000 and in default another two years,” Special Public prosecutor Pranab Kumar Panda said.
