Hindus Can Solemn 2 Marriages In Goa; Conditions Applied !
May 16: The debate for Uniform Civil Code, is going on for the implementation through out India. Many types of reactions are coming out about it, in which some people argue in favor of it and some people argue in opposition.
In Uttarakhand, the government has also stepped up in this sequence. When there is talk of bringing a civil code in the country, then Goa is also being discussed.
Goa is pertinent is because there is already a civil code and according to this Hindu men can also do two marriages, which is different from the Hindu Marriage Act.
Recently, Owaisi had said that the Bharatiya Janata Party is talking about it in other states, but Goa is being kept away from it. He told that in Goa, a Hindu man has the right to do two marriages and if the wife does not have a child till a time, then he can marry again.
Why so, this special rule is there in Goa?
As per the existing Hindu Marriage Act, 1955 no Hindu can have two wives together. If a man wants to marry a second time, then he has to get a divorce from the first wife. That is, marrying another while having one wife is a crime and doing so can also lead to jail.
Talking about Muslim religion, a man is allowed to have four marriages and he can have four wives. Because of this, there is talk of civil code and a similar legal demand can be made.
According to a report an amendment was made in the Civil Code of Goa in 1880.
The Portuguese king of that time had amended it and was given the right to do so on the basis of certain conditions. That is, in some circumstances the Hindu people of Goa can also marry another girl while having one wife. A second marriage can be done if the wife has not had a child for 25 years, or if she has not had a child after 10 years of marriage, or if she is unable to have a child. But, it can be done only under certain circumstances.
However, while getting married for the second time, the man must first take written permission from the old wife. Only after doing this the second marriage will be considered legal. According to reports, no marriage has taken place under this law for many years so far, because registration of every marriage is necessary in Goa and for the last few years the registration for marriage under this law has not been done.
The special thing is that till now no challenge has been made against this provision and no case of challenge has taken place in the court.
