Tripura HC Upholds Die In Harness Benefits To Married Daughter
Agartala, (Tripura), Feb 9: The High Court of Tripura has dismissed five writ petitions of the state government challenging eligibility of married daughters in qualifying for getting die in harness benefit in case of the death of an in-service parents.
A division bench of High Court comprising Chief Justice Indrajit Mahanty and Justice S G Chattopadhyay upheld the judgement passed by former Chief Justice Akil Kureshi with ruling that married daughters who are economically dependent on the deceased parents could be considered as an eligible candidate under the die in harness scheme.
After a long hearing, the High Court has disposed of five writ appeals of Tripura government, which argued the reverse, challenging the previous order. The advocate of the respondents, P Roybarman pointed out that the judgment stands significant as it does not give financial relief to married women by empowering them economically. The court has also rejected the discrimination being meted out against the married daughters on the basis of their gender and social set up, he said adding, and “The Court has set certain parameters to qualify for the eligibility that includes the claimant must be financially dependent on the deceased parent”.
