SC Defers Listing Of Petitions Filed By Two Warring Factions Of Shiv Sena
New Delhi, July 11: The Supreme Court on Monday deferred indefinitely both the disqualification proceedings – one initiated by the Deputy Speaker against rebel Shiv Sena MLAs and counter proceedings by Speaker against Uddhav Thackeray faction of the party MLAs, saying the matter would take some time to be listed.
“Tell the Speaker’s office not to go ahead with the proceedings,” a Chief Justice-led bench said.
The Supreme Court asked the Speaker of Maharashtra Assembly not to proceed with the disqualification proceedings of the Shiv Sena MLAs.
Uddhav Thackeray led Shiv Sena mentioned it’s plea in the Supreme Court challenging election of the new Speaker of Maharashtra assembly.
Appearing for the Uddhav led camp, senior advocate Kapil Sibal contended that the matter should be listed today itself, but the apex court said it would take some time. The matter was mentioned before the bench of Chief Justice NV Ramana as the bunch of petitions was not listed today despite a direction from the vacation bench to do so.
Sibal mentioned the matter and sought direction that disqualification proceedings not be taken forward by the Speaker until the matters are listed and heard.
The bench also comprising justices Krishna Murari and Hima Kohli asked Solicitor General Tushar Mehta to inform the Speaker not to proceed with the disqualification.
The apex court also said that the matter may not be listed tomorrow since the bench for hearing the matter is yet to be constituted.
