New Delhi, March 24 : Roots in Kashmir, an NGO of Kashmiri Pandits, on Thursday filed a curative petition in the Supreme Court, seeking probe into the alleged killing of Pandits in the Valley during 1989-90. The curative petition was filed before the Apex Court, challenging its 2017 order, which had dismissed the NGO’s petition for probe, citing long delay. On July 24, 2017, the Supreme Court had rejected the plea filed by the NGO, stating that it was difficult to have any probe and collect evidence on the issue more than 27 years after the exodus of Kashmiri Pandits. On October 25, 2017, the top court of the country had also dismissed the review petition. The curative petition filed by Roots in Kashmir before the Supreme Court sought direction to decide the case afresh on merit by way of providing hearing opportunity to the parties. The plea cited the example of 1984 Anti-Sikh riots case, where the court had taken cognisance, even after a lapse of more than 33 years. The Delhi High Court re-opened five cases related to Anti–Sikh riots, a judgment of year 1986, it added. “The Judgment and order is liable to be reviewed on the ground that the order as it appears is based on absolutely unsubstantiated presumption that no evidence is likely to be available after the passage of time ignoring the fact that trials are also proceeding in the some of the FIRs since year 1996,” the curative petition stated.
