SC Stays Allahabad HC Order Regarding Azam Khan’s Bail Condition

New Delhi, May 27: Supreme Court on Friday stayed the condition imposed by the Allahabad High Court order directing the District Magistrate (DM) to conduct a measurement of Mohammad Ali Jauhar University as part of the condition of bail granted to Samajwadi Party (SP) leader, Azam Khan, involved in many criminal cases.

A bench comprising justices DY Chandrachud and Bela M. Trivedi also issued notice on an appeal filed by SP leader, Azam Khan on the apprehension of demolition of Jauhar University as a part of the conditions of bail.

The bench while issuing notice in the matter also stayed the orders given by the Allahabad High Court to the District Magistrate.

The bench stated that, “Prima facie conditions imposed for the grant of bail are disproportionate and has no reasonable link to the means to secure the presence of the accused.”

The bench was hearing an appeal against the order of the Allahabad High Court as a part of conditions of bail directing the District Magistrate Rampur to hold a measurement of the property which is in dispute admeasuring the area 13.842 hectares in District Rampur and thereafter raise a barbed wire boundary and take physical possession of the property.

The appeal was mentioned before the Supreme Court vacation bench which agreed to hear the matter.

The Supreme Court bench led by Justice L. Nageswara Rao had on May 19 ordered to release Azam Khan on interim bail, and set a slew of bail conditions for his release.

Khan had been in jail for two and a half years and there are 89 FIRs filed against him.
